THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Why You’re Receiving This Notice

Federal law requires us to provide you with this Notice of Privacy Practices describing how we protect and use your Protected Health Information (PHI). This Notice is available upon request, posted in our office, and available on our website.

Our Legal Duties

We are required by federal and Colorado law to:

  • Maintain the privacy of your PHI

  • Provide you with this Notice

  • Notify you following a breach of unsecured PHI

  • Follow the terms of the Notice currently in effect

We may change this Notice. Any changes will apply to all PHI we maintain.

How We May Use and Disclose Your PHI (No Authorization Needed)

We may use and disclose your PHI for:

Treatment – To provide, coordinate, or manage your care, including sharing information with other providers (such as referring doctors, specialists, labs, or pharmacies).

Payment – To bill and collect payment from you, your insurance plan, or third-party payors.

Health Care Operations – For practice operations such as quality improvement, training, audits, accreditation, compliance, and business administration.

We may also contact you with appointment reminders and information about your care (by phone, text, or email).

Special Protections (2026 Updates)

Reproductive Health Care Privacy

Alive Dental will not use or disclose PHI for the purpose of investigating or imposing liability on any person for seeking, obtaining, providing, or facilitating reproductive health care that is lawful under the circumstances in which it is provided.

Substance Use Disorder (SUD) Records (42 CFR Part 2)

If we receive records that are protected under 42 CFR Part 2, those records receive additional confidentiality protections. They will not be used or disclosed in certain proceedings against you without the required consent or legal authorization.

Notice of Redisclosure

Information disclosed by us may, in some circumstances, be subject to redisclosure by the recipient and may no longer be protected by HIPAA.

Your Rights

You have the right to:

Get a Copy / Access Your Records
You may inspect or request a copy of your records. We may charge a reasonable, cost-based fee for copies. Colorado rules require records to be made available within seven (7) calendar days.

Request Corrections (Amendments)
You may ask us to correct PHI you believe is inaccurate or incomplete.

Request Restrictions
You may ask us to limit how we use or disclose your PHI. We are not required to agree to all requests; however, if you pay in full out-of-pocket for a service, you can request we not share that information with your health plan (and we must honor that request, as required by HIPAA).

Request Confidential Communications
You may request that we communicate with you in a specific way (for example, by a certain phone number or mailing address).

Receive an Accounting of Disclosures
You may request a list of certain disclosures of your PHI made during the last six years.

Questions or Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
